  1. PARTIES AND ACCEPTANCE OF GENERAL TERMS

On one side, the supplier of the products, FLOORBALL SHOP SPAIN SL (hereinafter “FLOORBALL SHOP”), B87593513, with its registered office at C. de Daoiz y Velarde, 12, 28280 El Escorial, Madrid, Spain, phone number +34 613972215, and email address info@oxdogpadel.es (hereinafter also referred to as the provider), is the owner of the website www.oxdogpadel.es, and presents the contractual document that will govern the purchase of products through the mentioned website.

On the other side, the User – Customer (hereinafter the User), who is registered on the website with a username and password, is fully responsible for their use and custody, and is responsible for the accuracy of the personal data provided to the provider.

By accepting this document, the user:

  • Has read, understands, and comprehends the content here.
  • Is an adult with sufficient capacity to contract.
  • Assumes all obligations outlined here.
  • Has read and accepts these general terms and conditions from the moment they purchase any offered product.

This document can be printed and saved by users. The provider offers the email address info@oxdogpadel.es for any questions regarding these terms.

These terms are valid indefinitely and apply to all contracts made through the provider’s website.

The provider reserves the right to unilaterally modify these General Terms, without affecting goods or promotions purchased before the modification, in order to improve the offered products. Users should review these terms before purchasing products.

It is advisable to keep a copy of the data contained in purchased products. FLOORBALL SHOP is not responsible for any loss of data, files, or damage resulting from a backup failure by the data holder.

The provider is not liable for any consequences resulting from improper use of the products sold on the website.

FLOORBALL SHOP’s civil liability for supplied products is limited to their value. The user waives any claims against the provider for dissatisfaction with products purchased on the website www.padelproshop.com, as well as for any access issues, including data loss or other information on the user’s computer or network.

  1. CONTRACT OBJECT

2.1 Scope of Application: This contract regulates the purchase-sale relationship between the provider and the user when the user accepts these purchase conditions during the online ordering process by checking the corresponding box. These general terms will apply from the day the order is placed.

The purchase-sale relationship involves the delivery of a specific product in exchange for a set price publicly displayed on the website.

2.2 Territory of Application: The virtual store at www.oxdogpadel.es is active worldwide.

2.3 Capacity to Contract: To place an order, you must be of legal age and have the capacity to contract.

2.4 Customer Acceptance: Order validation via the website is done by email and also implies automatic acceptance of the general terms. These terms are available on the website www.oxdogpadel.es or, if preferred, can be provided by email to the address mentioned above.

  1. PRICES

All prices displayed on FLOORBALL SHOP’s website, www.oxdogpadel.es, include VAT in accordance with current legislation. If the order is to be shipped to an address outside the European Union, VAT will be deducted at checkout or before, depending on the delivery country. Note: If the order is to be shipped to a delivery address outside the EU, it may be subject to import duties and taxes, which must be paid when the shipment arrives. The CUSTOMER will be responsible for these import duties and taxes. Please note that FLOORBALL SHOP has no control over these additional charges. FLOORBALL SHOP recommends checking with Customs Service for more information.

Our product prices are subject to change without prior notice. We reserve the right to modify or discontinue the Service (or any part or content thereof) without notice at any time. We will not be liable to you or any third party for any changes or price adjustments. Price changes will not affect orders placed prior to the change.

  1. ORDER PLACEMENT

FLOORBALL SHOP reserves the right to change prices and correct incorrect prices on all orders and final sales. If a price is incorrect, this may require FLOORBALL SHOP to cancel the purchase and refund the amount paid in the best possible way. This operation can be done at any time. Orders made in someone else's name without their consent will be reported to the relevant authorities.

Placing an order may require identification and registration on the website using a username and password.

According to Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the ordering process will follow these steps:

  1. Select the product by clicking “add to cart,” which will automatically add it to the “cart.”
  2. If you want to add more products, you can do so. If you accidentally added an item you don’t want, click on the option to remove it from the shopping cart.
  3. Once you have selected the products, click on “checkout” to complete the purchase. This will show a purchase confirmation (order summary). You will need to register and provide personal and delivery details, choose a carrier, and select a payment method. Some payment methods may incur an additional fee.
  4. You must accept the Privacy Policy and these General Purchase Conditions by checking the boxes. Once completed, you will be able to proceed with payment and select the payment method.
  5. After finalizing the order, you will receive a confirmation email at the provided email address.

The provider’s platform will inform you, once the ordering process is complete, via email about all characteristics, price, shipping methods, contract date, and estimated delivery of the purchased product. Please check your spam and junk email folders and ensure that delivery and personal details are correct.

If there is any error in the address or any other part of the order, you must immediately notify the email address provided on the website to correct the error.

For any questions, you can contact our Customer Service through the methods provided on the website. FLOORBALL SHOP offers FREE Customer Service via our contact email info@oxdogpadel.es. If you choose another communication method, you will be responsible for its cost. FLOORBALL SHOP also provides phone numbers in Spain, subject to your phone operator’s charges.

  1. RIGHT OF WITHDRAWAL

Under the Consumer Code (Legislative Decree 206/2005), you can return purchased products within 14 days of receiving your order. The products must be returned undamaged and properly packaged in their original packaging along with the warranty. In this case, the customer will bear the return shipping costs.

This right applies only if the product and its original packaging can be returned in the same condition as when received. If consumers exercise their right to return an order, they must contact FLOORBALL SHOP to obtain an address for returning the merchandise. If an item is damaged during transport, you should contact FLOORBALL SHOP within 14 days to obtain information about compensation.

You must return the product with all items it was delivered with, without damage or signs of wear, and not showing improper use or damage inconsistent with its nature, to the address we provide.

Please note that repairs/replacements will be charged in the following cases, even during the warranty period:

  • Failures or damage caused by misuse or neglect (e.g., impacts, dents, crushing).
  • Failures or damage caused by unjustifiable repair or modification.
  • Failures or damage caused by fire, water, or natural disasters like earthquakes.
  • Aesthetic changes from normal use and wear and tear.
  • If the store and purchase date are not indicated on the warranty, or if this information has been overwritten.
  • If the warranty is not presented correctly with the product.

This warranty ensures that you can receive a free replacement in accordance with the terms stated in this document and within the specified term, without restricting any legal rights of the customer.

  1. CONFIRMATION

Once we have received your order, we will send a confirmation to your email address. Therefore, it is important to provide a valid email address when placing the order. Keep this email so you can contact customer service if needed. The order confirmation (receipt) also serves as proof of purchase.

  1. PAYMENT

Orders placed in our online store can be paid using:

  • Credit card.
  • Paypal.
  • Bank transfer.

  1. PRODUCT

FLOORBALL SHOP reserves the right to adjust prices, add additional costs, and change product information, such as product images and offers, without prior notice. The product images and informational texts available reflect the product as accurately as possible. We reserve the right for any errors that may appear on the page and cannot guarantee that all images accurately represent the actual appearance of the products. Images may vary depending on your computer's color settings. All images should be considered as illustrations only and do not guarantee appearance or features.

The products offered on the website are related to sports equipment, but different products may be offered in the future.

  1. APPLICABLE WARRANTIES AND AFTER-SALES SERVICES

10.1 Warranty: All products come with a mandatory 3-year warranty, in accordance with the criteria and conditions described in Royal Legislative Decree 1/2007 of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, as well as Royal Decree-Law 7/2021 of April 27, which transposes EU directives related to various matters, unless stated otherwise for exceptional cases. For sports equipment, footwear, and clothing, the warranty period is determined by the manufacturer, not by FLOORBALL SHOP. The minimum period set by the manufacturer is two months, which may be extended in certain situations. If in doubt, contact FLOORBALL SHOP via email or WhatsApp at +34 613972215.

If the warranty requires the product to be sent to the manufacturer, FLOORBALL SHOP will provide instructions on how to proceed via email or WhatsApp at +34 613972215.

10.2 Defective Products: In the case of a defective product, FLOORBALL SHOP will proceed with repair, replacement, price reduction, or contract resolution (as appropriate), at no cost to the user. FLOORBALL SHOP is responsible for non-conformities that appear within a fixed period from delivery, provided the non-conformity is reported within two months of becoming aware of it. For returns due to an order error by FLOORBALL SHOP, if the product does not match the order due to an error on FLOORBALL SHOP's part, the user should notify the company by email as soon as possible. FLOORBALL SHOP will cover the cost of picking up the incorrectly sent product and delivering the correct one.

10.3 Warranty Exclusions: The warranty does not apply in the following cases:

  • Deterioration caused by adaptations, adjustments, or modifications made to a product without written agreement from the manufacturer.
  • Costs related to maintenance, repair, or replacement due to normal wear and tear.
  • Breakdowns and deterioration of accessories.
  • Damage caused by improper use, misuse, not following usage and maintenance instructions, or improper installation.
  • Damage caused by unauthorized persons or the user.
  • Damage caused by accidents, lightning, floods, fires, or any other external cause not attributable to FLOORBALL SHOP.
  • Use of the product outside of personal and private contexts, e.g., intensive professional use.
  • Products previously repaired by repair services other than FLOORBALL SHOP.

10.4 Replacement of an Irreparable Product: If the product is deemed irreparable, cannot be repaired, or the repair cost is disproportionate to its value, it will be replaced with an identical product. If this is not possible, a product with similar characteristics will be offered. The replacement of your product will conclude your sales contract and any extended warranties, as the new product will be covered by a new contract as a new purchase.

10.5 Warranty Periods: The periods distinguished in current legislation for general products are:

  • From acquisition (in the case of in-person purchases) or possession (in the case of online purchases) up to two years. Unless proven otherwise, it will be presumed that non-conformities appearing within the two years following delivery existed at the time of delivery.
  • From two years to three years from acquisition (in the case of in-person purchases) or possession (in the case of online purchases). After the initial period, the seller may require the consumer to prove that the defect was present from the start.

No more than two months should pass between when the customer experiences a problem with their product and when they notify FLOORBALL SHOP; otherwise, the product's warranty may be voided.

  1. DELIVERY AND CANCELLATIONS 

FLOORBALL SHOP ships worldwide. Deliveries are made in collaboration with various shipping companies. The delivery time will depend on the chosen delivery company, and the estimated time will be displayed when selecting the company; this may also incur an additional cost. For domestic shipments, the delivery time is 24 to 48 hours; for EU shipments, 2 to 3 days; and for international shipments outside the EU, 5 to 7 days. FLOORBALL SHOP is not responsible if these times are not met, as they are indicative.

The delivery will be made to the address provided by the customer. If the customer cannot be contacted due to absence, a new attempt will be made on the next business day.

You have the right to cancel purchases and return the delivered goods by contacting FLOORBALL SHOP’s customer service via email at the address provided above, within a maximum of 30 days from the receipt of the goods, provided the goods have not been unpacked and are in the same condition as when received. However, the customer will be responsible for the risk of transporting the returned goods to FLOORBALL SHOP.

If the customer believes that the delivery is delayed to the point that they no longer wish to receive the order, it is their responsibility to cancel the order. If the order has already been shipped, the customer is obligated to accept it. Cancellation is not valid until confirmed by FLOORBALL SHOP via email or phone. If a product is discontinued, FLOORBALL SHOP has the right to cancel the purchase and refund the amount paid to the customer. FLOORBALL SHOP will notify the customer of any replacement or equivalent product if available.

  1. PRODUCT AVAILABILITY:

Puede haber ocasiones en que sea imposible suministrar todos los productos debido a que éstos no estén en stock o disponibles en el momento de la compra. En estos casos, personal de FLOORBALL SHOP se pondrá en contacto con Ud. para darle a elegir entre las siguientes opciones:  

  1. a) elección de un producto alternativo, con características similares al producto a reemplazar;
  2. b) la comunicación de su disponibilidad, por si prefiere esperar a que dicho producto vuelva a estar disponible en la tienda.

Si declina nuestras sugerencias, el pedido relacionado con estos productos será cancelado y se le devolverá cualquier suma que hubiera satisfecho por los mismos.

  1. CLAIM CONDITIONS

It is important that the customer carefully inspect the products upon receiving the shipment to ensure they are not damaged and are correct. If your product suffers damage during transport, whether visible or hidden, you must report it to the shipping company as soon as possible. If you find that the item is damaged or does not match what you ordered upon receipt, you should also contact us within 30 days from the date of receipt of the product.

All claims should be directed to our customer service via our contact form on the contact page, by email at info@oxdogpadel.es, or by mobile phone at +34 613972215. Please provide the order number and the reason for your claim, and we will get in touch with you as soon as possible. The same process applies to returns. Defective products returned to FLOORBALL SHOP should be treated as if they were not defective. It is extremely important that all returns are packaged in a way that prevents damage during transport.

FLOORBALL SHOP reserves the right to replace defective products with others of the same model. If the item is discontinued, the customer will receive a full refund. If no errors or faults are found with the returned product, FLOORBALL SHOP will return the product to the customer.

  1. RESPONSIBILITY

FLOORBALL SHOP's responsibility for delivery errors is limited to the current terms of sale. FLOORBALL SHOP does not assume any direct or indirect liability, including but not limited to incompatibility, delivery delays, downtime, data loss, additional work, or other economic damages.

  1. FORCE MAJEURE

FLOORBALL SHOP will be exempt from liability for damages and other penalties if the performance of the contract is impeded, obstructed, or delayed by circumstances beyond our control. Such factors include, but are not limited to, government intervention, new or modified legislation, absence of state, war, fires, floods, labor disturbances, bans, restrictions, sabotage, transportation deficiencies, weather conditions, or supplier delivery failures, as well as exposure to criminal activities affecting the company’s operations.

  1. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights, including trademarks and copyrights, appearing on the website and in the published material, are owned by FLOORBALL SHOP or its subsidiaries or licensors. Any use of the site or its content, including copying or storing such content, in whole or in part, for purposes other than personal, non-commercial use, is prohibited without the permission of FLOORBALL SHOP.

  1. FRAUD

All frauds will be reported to the authorities, and FLOORBALL SHOP reserves the right to cancel the purchase if there is any suspicion of fraud.

  1. TERMINATION

FLOORBALL SHOP reserves the right to cancel your account and/or prohibit you from using the website www.oxdogpadel.es at its sole discretion. This may occur if, for example, FLOORBALL SHOP suspects that you have violated these Terms of Use. This termination may be done without prior notice.

  1. MODIFICATIONS

FLOORBALL SHOP may review these Terms of Use periodically. Each time you place an order with us, you will be subject to the terms in effect at the time of the contract between you and FLOORBALL SHOP. Therefore, you should visit this page regularly to review the current terms to which you are subject.

  1.       NULLITY AND INEFFECTIVENESS OF CLAUSES

If any clause in these General Terms is declared wholly or partially null or ineffective, such nullity or ineffectiveness will affect only that provision or the part of it that is null or ineffective, and the General Terms will remain in effect in all other respects, with the affected provision or part thereof being considered as if not included.

  1. APPLICABLE LAW AND JURISDICTION

These terms will be governed or interpreted according to Spanish law where not expressly stated. The provider and the user agree to submit any disputes arising from the provision of the products or services covered by these Terms to the courts of the provider's domicile (if a legal entity) or the user's domicile (if an individual).

If the user resides outside of Spain, the provider and the user expressly waive any other jurisdiction and submit to the courts of Madrid, Spain.
